These Terms and Conditions govern the use of agaricpromogifts.com, enquiries, purchases, personalised products and the contractual relationship between AGARIC and its customers.
A customer may be a consumer or a business customer.
A consumer is an individual purchasing goods for purposes outside their trade, business or profession.
Consumer rights that apply exclusively to consumers do not apply to business purchases.
Any individually agreed quotation or contract takes precedence over these general Terms where expressly agreed.
AGARIC makes reasonable efforts to ensure that product descriptions, materials, colours, dimensions and availability are accurate.
Product photographs may be illustrative.
Minor variations may occur due to screen settings, material characteristics, production batches and manufacturing processes, provided that such variations do not constitute a lack of conformity.
The price applicable to an order is the price confirmed before the order is concluded or stated in an individual quotation.
Where prices are displayed excluding VAT for business customers, this must be clearly indicated.
Before a consumer places a binding order, the total price including applicable taxes and all additional charges that can reasonably be calculated in advance must be displayed.
Unless expressly stated otherwise, product prices may exclude printing, engraving, embroidery, artwork preparation, special packaging and delivery.
Some products may be purchased directly, while others require an individual quotation.
Submitting an enquiry does not itself create a contract.
A contract is concluded when the customer accepts the quotation or order and AGARIC accepts the order in the agreed manner.
Order confirmation is normally sent by e-mail.
Customers may create a user account where this functionality is available.
The user is responsible for ensuring that the information entered is correct and for keeping their password secure.
Any suspected unauthorised use should be reported to AGARIC without undue delay.
Products may be personalised with logos, names, text, artwork, printing, engraving, embroidery or other suitable branding techniques.
AGARIC may provide a visual proof before production.
The customer must carefully check all visible elements before approval, including wording, spelling, logos, contact details, positioning and size.
Once the proof has been approved, AGARIC is not responsible for content errors that were clearly visible in the approved proof.
Colours displayed on a screen cannot be regarded as an exact printing reference.
The final appearance may be affected by the underlying material, product colour, surface treatment and production method.
Where an exact corporate colour is important, the customer should provide an appropriate colour reference where technically possible.
Customers should provide production-quality artwork.
Vector files such as AI, EPS or properly prepared PDF files are generally preferred for logos.
If artwork is not suitable for production, AGARIC may offer artwork preparation or adaptation. Any charge will be communicated before the service is performed.
The customer confirms that they hold all necessary rights and permissions to use any logos, trademarks, photographs, text or other artwork supplied to AGARIC.
The customer is responsible for third-party claims arising from materials supplied by the customer.
Available payment methods are displayed during checkout or specified in the relevant quotation.
AGARIC may require partial or full prepayment for customised or made-to-order products.
Estimated production and delivery times are displayed on the website or stated in the quotation.
For customised orders, the production period normally begins after all requirements have been fulfilled, including receipt of payment where required, receipt of suitable artwork and approval of the visual proof.
If delivery cannot be completed within the expected period, AGARIC will inform the customer and propose an appropriate solution.
A consumer entering into a distance contract generally has the right to withdraw from the contract within 14 days of receiving the goods without giving a reason, unless a statutory exception applies.

The goods must be returned within the statutory period following notification of withdrawal.
The consumer bears the direct cost of returning the goods unless otherwise agreed.
AGARIC will refund payments due under applicable law within the statutory period. For sales contracts, AGARIC may withhold reimbursement until the goods have been returned or the consumer has supplied evidence of having sent them back where permitted by law.
The right to withdraw without giving a reason does not apply to goods made to the consumer's specifications or clearly personalised.

This exception does not affect the customer's rights where the goods are defective, damaged or do not conform to the agreed order.
Consumers retain all mandatory rights relating to the conformity of goods under applicable consumer law.

Customers are encouraged to include the order or invoice number, a description of the issue and relevant photographs where useful.
The statutory consumer right to withdraw from a distance contract without giving a reason does not apply to companies, sole traders or other customers purchasing in the course of their business or professional activity.
Business transactions are governed by the relevant quotation, contract, these Terms and applicable commercial and contract law.
Personal data are processed in accordance with the Privacy Policy published on the website.
The parties will first attempt to resolve disputes amicably.
Slovenian law applies to contracts with business customers unless otherwise agreed in writing.
Where the customer is a consumer habitually resident in another EU Member State, this choice of law does not deprive the consumer of mandatory protection provided by the law that would otherwise apply.
AGARIC may update these Terms where required due to changes in legislation, business processes or website functionality.
The version in force when the relevant contract is concluded applies to that contract.
